All users of the ImageEn, IEvolution and IEVision components must agree to the following License Agreement.
1. LEGAL NOTICE
This License Agreement constitutes a valid and binding agreement between you and the author (
"Author") governing your use of ImageEn, IEvolution and/or IEVision, hereafter collectively referred to as the
"Software".
You are required to read this Agreement and agree to all of its terms and conditions before downloading, installing, or using the Software.
If you do not agree to all of the terms of this Agreement, you must not download, install, copy, or use the Software.
2. LICENSE AND USAGE
The Author grants you a limited, non-exclusive, non-transferable license to use the Software solely for the purpose of incorporating the
compiled components into your own applications, whether
COMMERCIAL, SHAREWARE, or FREEWARE.
Subject to the terms of this Agreement, you may distribute applications created using the Software without paying royalties to the Author.
You may distribute applications created using the Software, including any DLLs supplied with the Software that are required for the operation of those applications, provided that such distribution is solely as part of your application and
not as a standalone library, development component, SDK, or other reusable software component.
You may not:
◼Distribute the Software itself as a library or component;
◼Include the Software, or any portion thereof, in any commercial, shareware, freeware, or other library or component;
◼Create or distribute derivative libraries, components, SDKs, or development tools based upon the Software;
◼Make the Software available for use by third parties as a development or programming component;
◼Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent that such restriction is expressly prohibited by applicable law; or
◼Remove or alter copyright notices, license notices, or other proprietary notices contained in the Software.
Source Code Restrictions
The source code of the Software is
proprietary and confidential and may not be distributed, published, uploaded, disclosed, or otherwise shared with any person or entity not expressly authorized under this Agreement or by the Author in writing.
You may not submit, upload, paste, transmit, disclose, or otherwise provide any portion of the source code to any
artificial intelligence (AI), machine-learning (ML), large-language-model (LLM), code-generation, code-analysis, automated software, or similar system or service, whether operated by a third party or locally.
Without the Author's prior written permission, the source code may not be used as
training data, fine-tuning data, evaluation data, retrieval data, prompts, context, input data, or reference material for any such system or service.
This restriction applies regardless of whether the AI or ML system is operated locally, remotely, privately, publicly, commercially, or through an online service or API.
The Software is
not intended for use in the operation of nuclear facilities, aircraft navigation, communications systems, air traffic control, or any similar activities where failure of the Software could lead to death, personal injury, or severe physical or environmental damage.
3. DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY
The Software is provided
"AS IS" and without express or implied warranties of any kind, including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or suitability for any particular use.
The Author does not warrant that the Software is error-free, that all defects will be corrected, or that the Software will operate without interruption, errors, or other problems.
To the maximum extent permitted by applicable law, the Author shall not be liable for any damages suffered by you or any user of the Software, regardless of the legal theory on which such liability is based.
In no event shall the Author be liable for any loss of information or data, damage to computers or other hardware, loss of business, loss of profits, business interruption, loss of business information, or any incidental, special, indirect, consequential, or similar damages arising from the use of, inability to use, or reliance upon the Software or its documentation, even if the Author has been advised of the possibility of such damages.
The Author shall have no liability arising from or relating to Software that has been:
◼Modified or altered by anyone other than the Author;
◼Installed, operated, repaired, or maintained contrary to instructions supplied by the Author;
◼Subjected to abnormal physical or electrical stress;
◼Misused, neglected, or subjected to accident; or
◼Used in ultra-hazardous or safety-critical activities.
ImageEn is not certified or approved as a medical device for primary diagnostic imaging and must not be relied upon for primary medical diagnosis unless separately certified and approved for such use by the applicable regulatory authorities.
4. COPYRIGHT AND INTELLECTUAL PROPERTY
The Software is protected by copyright laws and international treaty provisions.
You acknowledge that
no title or ownership interest in the intellectual property embodied in the Software is transferred to you by this Agreement.
All title, ownership, and intellectual property rights in and to the Software remain exclusively with the Author. You acquire only the limited rights expressly granted under this Agreement.
All title and copyrights in the Software, including, without limitation, all software code, source code, object code, text, images, animations, video, audio, music, documentation, and other materials, together with all copies thereof, are owned by the Author or are used by the Author under applicable license rights.
You may not transfer, sell, rent, lease, sublicense, assign, or otherwise transfer the Software or any rights granted under this Agreement to another party, except as expressly permitted by this Agreement.
All rights not expressly granted to you under this Agreement are reserved by the Author.
5. TERMINATION
This license is effective until terminated.
The Author may terminate this license immediately if you breach any material term or condition of this Agreement.
Upon termination, you must immediately cease all further use and distribution of the Software, except that applications previously distributed in accordance with this Agreement may continue to be used and distributed in compiled form, provided that no further distribution of the Software itself, its source code, or the Software as a standalone component occurs.
Termination does not affect any rights, obligations, or liabilities that accrued before termination.
The provisions relating to
source-code restrictions, intellectual property, disclaimer of warranty, limitation of liability, governing law, and dispute resolution shall survive termination of this Agreement.
6. SEVERABILITY
If any provision of this Agreement is determined by a court or other competent authority to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.
The invalidity or unenforceability of any particular provision shall not affect the validity or enforceability of the remaining provisions.
7. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with the
laws of the jurisdiction designated by the Author, without regard to its conflict-of-law principles.
The courts of the jurisdiction designated by the Author shall have jurisdiction over disputes arising from or relating to this Agreement or the Software.
Nothing in this section shall be interpreted as excluding or limiting any mandatory rights or protections that cannot lawfully be excluded or limited under the laws applicable to you.
8. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and the Author concerning the Software and supersedes all prior or contemporaneous agreements, understandings, communications, and representations concerning the Software.
No amendment, modification, or waiver of this Agreement shall be effective unless made in writing by the Author.
The failure of the Author to enforce any provision of this Agreement shall not constitute a waiver of the Author's right to enforce that provision or any other provision in the future.
